A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without lawful basis.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The situation originates in a mistaken deportation to El Salvador in March, which the government later admitted was an mistake. Following his return to the United States to answer human smuggling allegations, he was detained in immigration detention.

In her decision, the judge noted that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
